Accident Terms and Definitions

Tire Problems
Under-inflation, the most frequent cause of tire failure, is considered the main culprit in the recent Firestone tire-failure fatalities. Uneven or worn-out tires are the next most serious problem and can also lead to tire failure.

Subpoena
Document issued by the authority of the court to compel a witness to appear and give testimony or produce documentary evidence in a proceeding. Failure to appear or produce is punishable by contempt of court.

Burden of proof
Measure of proof required to prove a fact. Obligation of a party to probe facts at issue in the trial of a case.

No-Fault Auto Insurance
Some states are adopting a no fault auto insurance system which requires you to have minimum insurance in the event you're injured. Your insurance company automatically pays for your damages, regardless of who is at fault for the accident.

Arbitration
the hearing and settlement of a dispute between opposing parties by a third party whose decision the parties have agreed to accept.

Pedestrian Manifestations
Those items of evidence deposited at the collision scene by the pedestrian during or following impact.

Reaction Time
The motorist who is not alert cannot cope with a sudden emergency as quickly as is necessary. An overly relaxed driver requires more time to react to an emergency than does an alert one.

Soft Tissue Injury
Injuries sustained to the muscle, skin, connective tissue.

Comparative negligence
Negligence of a plaintiff in a civil suit which decreases his recovery by his percentage of negligence compared to a defendant's negligence.

Choice no fault
In some state a hybrid no fault system known as " choice no fault " exists. In these states, you may choose to be insured under a strict no-fault plan, in which case you're unable to sue an at fault driver and also can't be sued if you're at fault.

Contact our Topeka Accident Lawyers if you have ever experienced a personal injury and think others are at fault for the accident.
